Terms of Use (End User License Agreement)

1.Summary

These terms apply to Chess Best Move (“the app”), made by Motomatic LLC (“Motomatic LLC”, “we”, “us”), when you get it from Apple’s App Store. This summary is for convenience; sections 2 to 17 are the terms.

• The app is free software, licensed to you under the GNU General Public License version 3 (GPLv3). Nothing in these terms takes away or restricts any right GPLv3 gives you.
• The terms Apple requires for App Store apps apply to the copy you download from the App Store and to purchases made in it.
• Purchases are charged to your Apple Account. Subscriptions renew automatically until you cancel them in your Apple Account settings. Apple handles refunds.
• The app comes without warranty to the extent the law allows. Motomatic LLC, not Apple, is responsible for the app and its support.

2.Acknowledgment

These terms are concluded between you and Motomatic LLC only, and not with Apple Inc. (“Apple”). Motomatic LLC, not Apple, is solely responsible for the app and its content. These terms do not provide usage rules for the app that conflict with the Apple Media Services Terms and Conditions or the Volume Content Terms as of the effective date above, which Motomatic LLC acknowledges it has had the opportunity to review.

3.License of the Software: GPLv3

Chess Best Move is free software. Motomatic LLC licenses the app’s software to you under the GNU General Public License, version 3, as published by the Free Software Foundation. The full text of the license is at https://www.gnu.org/licenses/gpl-3.0.html. The app includes the Stockfish chess engine, which its authors license under GPLv3 or, at your option, any later version, and the app as a whole is distributed under GPLv3.

Under GPLv3 you may run the app, study how it works, change it, and share copies of it, changed or unchanged, as long as you follow GPLv3’s conditions when you share. The Corresponding Source of each App Store version, as section 1 of GPLv3 defines it, is published at https://github.com/ciscoriordan/chess-best-move, with a tag for each version. See the Source Code page.

GPLv3 and these terms fit together as follows:

1. Nothing in these terms limits, conditions or adds restrictions to the rights GPLv3 gives you (GPLv3 section 10). This applies to every section below, including the scope of license, legal compliance, third-party terms and third-party beneficiary sections.
2. If any part of these terms conflicts with GPLv3 as applied to the app’s software, GPLv3 controls, and that part does not apply to the software.
3. Your rights under GPLv3 do not depend on accepting these terms; GPLv3 alone governs them. These terms cover your download from the App Store, your purchases, and the matters Apple requires.
4. Components the app includes are licensed by their authors under their own licenses, listed on the Source Code page and in the app’s Licenses screen.

4.Additional Term under GPLv3 section 7

For material in the app whose copyright Motomatic LLC holds, the following additional term applies, as GPLv3 section 7(e) permits: Motomatic LLC does not grant rights under trademark law to use the name “Chess Best Move” or the app icon. GPLv3 still lets you use, change and share that material as copyrighted work, and you may state accurately that a work is based on Chess Best Move.

5.Scope of License for the App Store Copy

In addition to your rights under GPLv3, Motomatic LLC grants you a non-transferable license to use the copy of the app you obtain from the App Store on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the app may be accessed, acquired and used by other accounts associated with you, as the purchaser, through Family Sharing, volume purchasing or Legacy Contacts. Family Sharing applies only to the app download itself; the app’s in-app purchases are not shared (section 6).

This license covers what Apple delivers to your Apple Account: the App Store download, re-downloads and updates, and your in-app purchases. Those stay with your Apple Account and cannot be transferred. It is not a limit on your rights under GPLv3. The software itself is licensed to you under GPLv3, so you may run, copy, change and share it, in source or object form, including on devices you do not own and by passing copies to others. Apple encrypts the App Store copy for your Apple Account, so to share the app, build it from the published source code. As GPLv3 section 3 provides, Motomatic LLC waives any legal power to forbid circumvention of technological measures to the extent such circumvention is effected by exercising rights under GPLv3.

6.In-App Purchases and Subscriptions

Free Analyses

First downloads before November 1, 2026 at 12:00 UTC (covering October 31 worldwide) keep unlimited analyses permanently under the free launch offer. Existing users qualify after updating. For downloads after that cutoff, the app includes 3 free analyses, which do not refill. What uses an analysis, and what does not, is explained on the Support page.

Pro Weekly and Pro Yearly

• Pro Weekly and Pro Yearly are auto-renewing subscriptions that give unlimited analyses while they are active. You can hold one of them at a time, and switching between them takes effect at your next renewal.
• Payment is charged to your Apple Account when you confirm the purchase.
• A subscription renews automatically for another week or year unless you cancel it at least 24 hours before the end of the current period. Renewals are charged at the subscription’s regular price. If you started with a discounted price through an App Store offer, the regular price applies from the first renewal after the offer ends. If the price changes, Apple’s rules for notice and, where required, your consent apply. Your Apple Account is charged for the renewal within the 24 hours before the current period ends.
• You can manage or cancel a subscription in your Apple Account settings: on your device, open Settings, tap your name, then Subscriptions. While you are subscribed, the app’s Settings also has a Manage subscription button. Canceling stops future renewals, and Pro stays active until the end of the period you paid for.
• Prices are shown in the App Store and in the app before you buy, in your local currency.

Pro Lifetime

Pro Lifetime is a single payment that gives unlimited analyses, with no renewal. Buying it does not cancel an existing subscription; cancel the subscription in your Apple Account settings to stop its renewals.

15 Analyses

15 Analyses is a one-time purchase of 15 analyses. Purchased analyses do not expire. Pro is used first, then free analyses, then purchased analyses, and any analyses you have left are kept while Pro is active. The remaining balance of 15 Analyses follows your Apple Account to your other devices when iCloud Keychain is turned on. Analyses have no cash value.

Restoring Purchases, Family Sharing and Approval

• Restore purchases is available on the purchase screen and in the app’s Settings. Pro, including Pro Lifetime, applies on every device signed in to the same Apple Account.
• Family Sharing is not available for the app’s in-app purchases.
• When a purchase needs approval, for example through Ask to Buy, it is completed only once it is approved.

Refunds

Purchases are billed by Apple, and Apple handles refund requests under its own policies, for example at reportaproblem.apple.com. If Apple refunds a Pro purchase, the Pro access that purchase gave ends. If Apple refunds a purchase of 15 Analyses, its 15 analyses are removed from your balance, never below zero.

Purchases and GPLv3

Purchases unlock features in the copy of the app distributed through the App Store. Paying is not a condition of your rights under GPLv3, and a purchase does not change those rights.

7.Maintenance and Support

Motomatic LLC is solely responsible for providing any maintenance and support services for the app, as described on the Support page and at support@motomatic.com, or as required under applicable law. You and Motomatic LLC acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the app.

8.Warranty

The app’s software is provided under GPLv3 without any warranty, to the extent permitted by applicable law, as section 15 of GPLv3 states (section 9 below follows GPLv3 section 16 on liability). Stockfish and the other components are provided by their authors without warranty.

To the extent any warranty applies to the app and is not effectively disclaimed, Motomatic LLC alone is responsible for it, not Apple and not the authors of Stockfish or of other components. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app, if any, to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be Motomatic LLC’s sole responsibility.

Recognition can misread a board, and an engine evaluation depends on the position you confirm and the think time you choose. Check the position before relying on a result.

9.Limitation of Liability

To the extent permitted by applicable law, neither Motomatic LLC, nor the copyright holders of the app’s components, nor anyone who changes or shares the software as GPLv3 permits, is liable to you for damages, including any general, special, incidental or consequential damages arising out of the use of or inability to use the app, even if told of the possibility of such damages. Nothing in these terms limits Motomatic LLC’s liability to you beyond what applicable law permits.

10.Product Claims

You and Motomatic LLC acknowledge that Motomatic LLC, not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession and use of the app, including, but not limited to: (i) product liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation.

11.Intellectual Property Rights

You and Motomatic LLC acknowledge that, in the event of any third-party claim that the app or your possession and use of the app infringes that third party’s intellectual property rights, Motomatic LLC, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.

12.Legal Compliance

You represent and warrant that (i) you are not located in a region that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” region; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. This representation concerns your download from the App Store and your purchases. It is not a condition on your rights under GPLv3.

13.Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the app, for example your wireless data service agreement and the terms of service of any chess site or app whose screenshots you analyze. This restates obligations you already have under those agreements; it adds no condition to GPLv3.

Most chess sites do not allow engine help in games you are playing.

14.Third-Party Beneficiary

You and Motomatic LLC acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these terms, and that, upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary. Because these terms add no restriction to your rights under GPLv3 (section 3), that right of enforcement does not reach those rights.

15.Privacy

The privacy policy explains how the app handles data. In short, the app does not collect data and sends nothing to Motomatic LLC.

16.Changes to These Terms

We may update these terms for later versions of the app; the effective date above shows when they last changed. A change never takes back the GPLv3 license you already received for a version of the software, which is irrevocable as long as you meet its conditions, as GPLv3 section 2 provides.
